What is meant by the right of withdrawal

The “Right of Withdrawal” is defined as the Consumer's right to forgo the purchased goods due to a “change of mind,” without being required to provide a reason, while remaining subject to the obligations described below.

The “right of withdrawal,” which is legally provided for and regulated, should not be confused with the sales formula known as “money-back guarantee,” which is not legally mandated but is often used solely for “commercial promotion” purposes.

To exercise the right of withdrawal pursuant to Legislative Decree no. 206/2005 (Consumer Code), a registered letter with return receipt must be sent within 10 working days of receipt of the products to the following address:
Soc. Agr. Paltrinieri Gianfranco s.s Via Cristo, 49

In the case of faxes and e-mails, the right of withdrawal must be confirmed by registered letter with return receipt within the following 48 hours to the address:
Soc. Agr. Paltrinieri Gianfranco s.s Via Cristo, 49 41030 Sorbara (MO)

.Our response will be sent via e-mail or post. It is not possible to exercise the right of withdrawal for only a portion of the sold goods. Customers purchasing with a VAT number cannot exercise the right of withdrawal. The return must take place within 10 days of our confirmation sent via email, fax, or post.

Returning goods due to the right of withdrawal

The products to be returned must be absolutely unused, contained exclusively in their original packaging, which must in no way be opened or tampered with, and shipped to:
Soc. Agr. Paltrinieri Gianfranco s.s Via Cristo, 49 41030 Sorbara (MO).

If the returned products do not have their original packaging or have been used in any way, the right of withdrawal will be automatically considered void. Consequently, the products will not be accepted and will be immediately returned to the sender at their expense.

Purposes of the Processing of Collected Data

The User's Data is collected to allow the Owner to provide its services, as well as for the following purposes: SPAM protection, Statistics, Contacting the User, Interaction with social networks and external platforms, Commenting on content, and Payment management.

The types of Personal Data used for each purpose are indicated in the specific sections of this document.

Refund times in application of the right of withdrawal and competent court

The total amount paid on the invoice, minus accessory costs incurred by the Company (packaging, shipping costs, reconditioning), will be refunded within 30 days of receipt of the goods.
The refund will be issued via bank transfer (to the details indicated by the Consumer). The only costs borne by the Consumer will be those related to the shipping for the return of the goods.

For civil disputes concerning the application of the “Right of Withdrawal,” the exclusive territorial jurisdiction is the court of the place of residence or domicile of the consumer, if located within the national territory.

Complaints, Returns, Reshipments, Cancellations, Failure to collect goods, refusal of goods

Any complaint must be forwarded online via e-mail or fax. Reports received by telephone cannot be considered a valid formal complaint. The Customer/Consumer will receive an e-mail confirming the opening of the complaint within the following three working days; the same communication will provide instructions for the procedure and requests for clarifications or documentation.

For complaints submitted within six months of delivery, the Company reserves the right to verify the existence of the defect claimed by the Customer/Consumer, which must be carried out at the Company's Headquarters, before granting the remedy provided for by the Warranty Rules. Goods found to be defective and purchased within the last six months will obviously be replaced.

Shipping costs for the return of defective goods are always borne by the Customer/Consumer. Reshipment costs, within six months of purchase, are borne by the Company. Shipments of goods made by the Customer/Consumer and directed to the Company on a "carriage forward" basis will not be accepted.

In such cases, the goods will be refused and sent back to the sender. The Customer/Consumer may cancel the purchase order within the following 12 hours by notifying the Company via e-mail or fax. Cancellations via telephone will not be considered valid. In the event of failure to collect the ordered goods by the Buyer for any reason, or in the event of refusal of goods at the time of delivery, and in the case of cancellations made beyond the established deadlines, the Customer/Consumer who formally placed the order will always be required to pay the relative shipping and return costs to the Company, which will provide proof of the exact amount.

Without prejudice to the regulatory protection provisions in favor of the Buyer regarding the “Right of Withdrawal” and outside the cases provided for by the aforementioned legislation, in the event of non-compliance by the Buyer, pursuant to the current Legal Regulations on Sales Contracts and, specifically, the protection of the Seller's Rights, the purchase order is considered a contract for all legal purposes; therefore, considering the Customer/Consumer's contractual non-compliance as an unfairly suffered financial loss, the Company will pursue every legitimate procedure, including judicial ones, for the recovery of the expenses incurred.
